01/07/2010 - Entry into force today, 1 July, in Lombardy and Emilia Romagna, the obligation to deliver the energy performance certificate (ACE), along with leases of property.

The obligation for the landlord to the tenant to deliver a certified copy of the ACE is provided for in Article 9.2 letter g) of the DGR VIII / 8745, and triggered in the event of leases, leasing and rental company including real estate, whether new or renewed, referring to one or more units.

contract for 'new' is defined as those completed since July 1, 2010; contract for 'refurbished' one who has suffered an express or tacit renewal from 1 July 2010. Failure to deliver ACE will be punished with an administrative fine of 2,500 to 10,000 €. Are excluded from the buildings of public housing rented housing and buildings free loan or beneficial.
Emilia Romagna
The requirement to attach the energy performance certificate also leases - in force since 1 July 2010 - provided for by Resolution 156/2008 , which lays down provisions on energy efficiency requirements and procedures of certification of buildings. Nevertheless, no penalties for failure to produce the certificate.

Recall that, under national law, the obligation to attach the energy performance certificate to the acts of buying a property and in the case of leases, to deliver or make available to the tenant 's energy performance certificate, was repealed by Act 133/2008 ( read more). For this provision, Italy has been put in default by the Commission European Union ( read more).
The obligation does exist in some regions which, in anticipation of national guidelines, had legislated on this matter, namely: Lombardia, Emilia Romagna, Piedmont, Valle d'Aosta, Liguria, Umbria, Province of Trento and Bolzano.
For example, in Piedmont the obligation to deliver the energy certificate together with the leases entered into force on 1 October 2009 (read more ) in Valle d'Aosta the obligation to provide or deliver to the lessee the energy performance certificate is in force since 2008 (read more ). In Liguria the requirement to attach the ACE to the lease for the individual units is operational from 8 May 2009 (read more ).
